Hendershot Cowart P.C. won a Texas jury trial on behalf of a family-owned self-storage facility in a breach of contract case, securing $764,391.83 in damages, including attorney’s fees.
Our client, a family-owned climate-controlled self-storage facility in Ingleside, Texas, filed suit against Mueller Supply Company, Inc. in 2021, alleging that the defendant breached a contract to design and manufacture a steel structure and intentionally or negligently made several misrepresentations relating to the quality of its work and materials, the charges for its work, the characteristics of its materials, the source of various components, its knowledge and experience in the self-storage building industry, and the time Mueller would take to complete its work.
Following a five-day jury trial, a San Patricio County jury found that Mueller committed fraud against our client and knowingly engaged in deceptive acts or practices that caused damages to our client. The jury awarded our client $764,391.83 in damages, including attorney’s fees.
The Hendershot Cowart team included litigation attorneys Ray Panneton and Katy Penick and paralegal Jacky Cortiaus.
“When a party is not willing to accept responsibility for its shortcomings, we look to a jury for accountability, which is what we did here,” said Hendershot Cowart shareholder Ray Panneton, lead trial counsel. “We are pleased with the jury’s verdict, and it affirms our belief in our client’s case and the importance of persuasive arguments.”
